  • ADMINISTRATIVE/ BIOGRAPHICAL HISTORY

    Justice James Staples was born in Sydney in 1929. While a student at Sydney University he joined the Australian Communist Party but was expelled in 1956 for circulating Nikita Khrushchev’s secret speech denouncing Stalin’s crimes. He was admitted to the New South Wales Bar in 1960 and became active in the Council for Civil Liberties. Much of his work as a barrister was pro bono, representing underdogs and taking on the Establishment. He took on cases that represented causes such as conscientious objection to conscription for the Vietnam War, abortion law reform and prison reform. In 1975 he was appointed as a Deputy President of the Conciliation and Arbitration Commission. After the Commission was abolished in 1989 and replaced by the Industrial Relations Commission, all the then serving judges were re-appointed except for Staples. No official reason was given but his penchant for colourful language and an unconventional approach to dispute resolution had certainly not done him any favours. Throughout his career he championed both civil liberties and prison reform movements in New South Wales. He died in 2016.
